City rules
Can I do that in Bucyrus?
The questions buyers ask before the fence goes up, from Bucyrus code, permit pages and local reporting. Rules change and HOA covenants can be stricter, so confirm with Miami County before you build.
Who sets the rules
Bucyrus is unincorporated, so there is no city code. Zoning, building permits and septic permits are handled by Miami County Planning and Zoning (913-294-9553) and Code Services (913-294-4145) at 201 South Pearl Street, Suite 201, Paola.
Building permits, sheds and barns
Miami County requires a permit before building any new structure, regardless of zoning, and for many repairs or alterations. Ask Planning and Zoning and Code Services which size limits and codes apply to a shed or barn. Only one single-family home is allowed per property, though an accessory dwelling unit can be allowed if it meets county standards.
Septic and new home permits
A new home on a septic system needs a soil profile analysis ($350) and an onsite wastewater installation permit ($350) before the county issues a building permit. A driveway entrance permit ($50 application) is also required.
Burning
Miami County does not allow burning of any material without a burn permit. Permits are free and available online, and pasture, ditch and grassland burns also need one.
Fireworks
In Miami County, consumer fireworks may be discharged July 1 to July 7 and December 31 to January 1, between 8 a.m. and 11 p.m., by people at least 18 years old.
Livestock and horses
Miami County does not limit the number of horses or livestock you may keep. The county guide suggests planning on about 5 acres to graze one horse for a year, and landowners must treat noxious weeds on their own land under Kansas law.
Trash
In unincorporated Miami County, trash pickup is provided by contracted private haulers. The county transfer station takes bulk items and has a household hazardous waste facility; call Road and Bridge (913-294-4377) for details.
Fences
Miami County’s building code does not require a building permit for fences up to 6 feet tall, and fences tied to an agricultural use are exempt at any height. Taller non-farm fences need a permit from Miami County Building Safety.
Pools
Miami County requires a building permit for swimming pools, except prefabricated above-ground pools that are less than 24 inches deep and hold no more than 5,000 gallons. The county has adopted the International Swimming Pool and Spa Code.
Solar
Solar panel systems are not on Miami County’s list of work exempt from a building permit, and the county code requires solar photovoltaic systems to be designed to accepted engineering practices. Check with Miami County Building Safety before installing.
Short-term rentals
As of September 2025, Miami County had no short-term rental regulations for unincorporated areas, and the Planning Commission was reviewing a draft that would require annual registration by January 31 with Miami County Planning and Zoning.
Data centers and large energy projects
In February 2026, the Miami County Commission discussed a possible moratorium on data centers, solar arrays, wind farms and battery storage outside city limits while the county writes zoning rules for them. Check with Miami County for the current status before buying land for, or near, a large project.
Home businesses
Miami County allows home occupations under Article 20 of its Zoning Regulations. Only people who live in the home may work in the business, materials may not be stored outdoors, and a sign needs a Planning Director permit and is capped at 6 square feet (Sec. 20-2.01). Music and art lessons are limited to 5 pupils at a time, and horse boarding is limited to 5 horses not owned by the residents (Sec. 20-2.02).
Garage sales
County zoning allows garage sales as long as a sale on the same parcel runs no more than 4 consecutive days and happens no more than twice in any 12-month period (Sec. 20-2.02.2.N). One unlit garage sale sign per lot, up to 6 square feet and 6 feet tall, is allowed without a permit (Sec. 18-3.01).
Accessory dwellings
In the county’s Countryside (CS) district, one accessory dwelling unit is a permitted use. It may be inside, attached to, or detached from the main home, and the owner must live in either the main home or the accessory unit (Sec. 5-2.01.12). Duplexes and multifamily homes require planned development zoning.
RV and boat storage
In the Countryside (CS) district, open or enclosed storage of one or more boats or RVs as a land use requires a conditional use permit (Sec. 5-2.02.15). Living in an RV while you build a house is allowed only with a temporary-use permit, and a mobile home cannot be placed on the property for that purpose.
Pets and kennels
Miami County sets no limit on dogs or cats kept as personal pets. Kansas treats 20 or more as an animal shelter or pound, which must meet county kennel zoning rules, and kennels need a conditional use permit in the Countryside district (Sec. 5-2.02.18).
Manufactured homes
Miami County allows manufactured homes only if they are 1994 or newer, carry the federal HUD compliance label, have at least 950 square feet of living area and sit on a permanent foundation designed by a Kansas-licensed engineer or architect. Moving one on any county or state road needs a moving permit from the County Clerk (913-294-3976). (Miami County Zoning Regulations; county handout)
Garage required for new homes
In unincorporated Miami County outside Community Growth Areas, every new home must have an attached or detached garage or accessory building that is fully enclosed and at least 200 square feet. A detached one must sit close to the house. County handouts give 100 feet in one place and 200 feet in another, so confirm with Planning and Development at 913-294-9553.
Re-roofing and remodeling
Miami County requires a permit for re-roofing and for almost any work beyond routine maintenance or minor repair, and you need the permit before the work starts. Permit fees are based on the value of the construction, and a new bedroom (any room of 70 square feet or more) may require septic review by Environmental Health (913-294-4117).
Living on site while you build
Miami County does not allow you to place a mobile home on your land to live in while you build your house. You may live in a recreational vehicle temporarily during construction, but only with a permit.
Signs
Sign permits are filed with a building permit and reviewed under Article 19 of the Miami County Zoning Regulations. The fee is $50 for staff review or $100 if Planning Commission approval is needed, and any sign whose top is more than 6 feet above grade needs a structural design sealed by a licensed engineer.

Bucyrus history, jobs and parks
A little history
Bucyrus was named after Bucyrus, Ohio, and its post office was established in May 1887. The post office building at 112 4th Avenue dates to 1921; Bob and Gail Foote bought and renovated it when it faced closure in 1991 and leased it back to the Postal Service for 30 years. An F5 tornado narrowly missed the town in 1957, and New Yorker cartoonist and illustrator Garrett Price was born here.
Where people work
Agriculture is the local business: the Foote family has farmed in the area since the 1940s, and Foote Cattle Company, founded by Bob Foote in 1985, grew into one of the largest feedlot and ranching operations in the country. Bucyrus is part of the Kansas City metro area, about 35 miles south of Kansas City, Kansas, so many people commute north into Johnson County and the metro.
Parks & outdoors
Hillsdale State Park, between Spring Hill and Paola, has a reservoir of about 4,500 acres with 51 miles of shoreline open to fishing, plus about 32 miles of marked horse trails in the Saddle Ridge equestrian area. The park and adjoining wildlife area cover more than 12,000 acres, with about 7,000 acres open to hunting.

Do I need a permit to build a pond on my land?
Miami County generally does not require a permit for a pond unless it is in the floodplain, and no part of the pond may sit in the road right-of-way. State permits may still apply, and the Natural Resources Conservation Service can advise on design.
How can I tell if a rural lot is buildable?
Miami County offers a $100 Zoning Verification that confirms whether a lot meets the county’s minimum requirements. Septic, road entrance and floodplain rules can still limit what you build.
